TERMS

Livefy terms of service

1. The short version

  • An hour of Livefy is one hour of translation in one caption language. Every caption language uses its own hours. Pause stops translation.
  • The free trial is for a church to try Livefy on its regular services. It is not for one-off events.
  • While your plan is active, unused hours carry over. They can be used only while the plan is active.
  • When a plan ends, its hours and any free hours end with it. Hours you buy outright stay, and never expire.
  • Refunds: within 30 days of a payment, for the hours of that payment you have not used, once per church.
  • Livefy is machine translation. It makes mistakes. Do not rely on it where a mistake could cause harm.
  • Services run from a laptop or desktop computer. Phones and tablets can read and listen, but cannot run a service.

2. Who we are

Livefy is run by Genesis One, a trade name of MARDANIA LLC, 2834 Hamner Ave #1014, Norco, CA 92860, United States. “We” and “us” in these terms mean MARDANIA LLC, doing business as Genesis One. “You” means the church or organisation that uses Livefy, and the people who use it on its behalf.

3. Agreeing to these terms

By creating an account, running a service or paying for Livefy, you agree to these terms and to our privacy policy, which says what we keep and why.

The person who opens the account must be at least 18 and able to agree on behalf of the church or organisation. If you are not, do not use Livefy.

4. What Livefy is

Livefy turns what is said at a service or event into live captions in other languages: on a projector or TV, in a livestream, and on the phones of the people present, who can also listen to a translated voice.

A service runs from a laptop or desktop computer, in Chrome or another browser built on Chromium, with sound from your microphone or sound desk and a working internet connection. Phones and tablets can read captions and listen, but cannot run a service.

People who read or listen on their phones need no account and do not agree to anything with us. Your church is responsible for how it invites them.

5. Accounts

  • The person who opens the account is its owner. Only the owner can pay, change the plan, buy hours, invite people to help and delete what the church keeps.
  • People the owner invites can run services, but cannot pay or change billing.
  • One account per email address. Give us true details and keep them up to date.
  • Keep your password to yourself. You are responsible for what is done with your account until you tell us it has been misused.
  • We may refuse a sign-up, for example from an address used for misuse before.

6. The free trial

A new church gets 4 hours of translation free, with no card. Adding a card at the start of the trial adds 2 more hours. That card is not charged unless you later choose to buy something.

The free hours are for the first 14 days after you sign up. Hours not used by then end, and we send you one email the day before. Your account, its history and its settings stay, and so do any hours you bought.

The free trial is for a church to try Livefy on its regular services, such as its Sunday and midweek services, before it chooses a plan. It is not for one-off events such as conferences, weddings or funerals. For those, buy hours or an event pack.

One trial per church. We also give each internet connection one free trial every 30 days, and one card starts one trial. We may end a trial, or close an account, that is used for a one-off event or opened again to get another free trial.

7. How hours are counted

  • An hour of Livefy is one hour of translation in one caption language. With two caption languages running, an hour of translation uses two hours.
  • Pause stops translation, for example during songs or a break. Resume starts it again.
  • If a church’s computer does not report a service, for example because it crashed or the page was closed, we count that time from our speech provider’s record of how long the connection was open, as one language, and take it off the church’s hours. Each such charge is listed in your history.
  • When your hours run out during a service, a monthly or yearly plan (or a Network agreement) carries on for 30 more minutes of translation, which come off the next hours added to your account, whether you buy them, renew or choose a new plan. Until then your balance shows below zero. Like all hours, each caption language uses its own minutes, so with two languages they last half as long. Without a monthly or yearly plan, translation stops when your hours run out.
  • The console counts down the last 30 minutes of translation before it stops. Add hours in that time and the service carries on. If it stops, add hours, then press Resume service in the same browser tab within two hours of the stop to carry on the same service.
  • Hours are used in this order: free hours first (trial, referral and any we give you), then your plan’s hours, then hours you bought. So the hours that would end soonest are used first.
  • Dubbed audio uses hours too: in each language, the time the service was live inside the recording you choose, taken when the dub starts and only if enough hours are left. Making it again for a stretch already dubbed in that language uses no more. A free trial can make a preview of up to 10 minutes instead, using no hours, three in all.

8. Plans

Plans are paid monthly or yearly. Each gives a number of hours every month. The plans, their prices and their hours are on the pricing page.

  • A monthly plan adds its hours each month when it renews. A yearly plan adds twelve months of hours on the day you pay.
  • A plan renews by itself, monthly or yearly, until you cancel it.
  • You can change plan on the Billing page. A move to a bigger plan takes effect straight away: you pay the difference for the rest of the period, and that share of the extra hours is added at once. The Billing page shows what any change costs before you confirm it.
  • You can cancel from the Billing page at any time. Cancelling stops the next payment. Your plan carries on until the end of the period you have already paid for.

9. Unused hours and when a plan ends

While your plan is active, hours you do not use roll over, so a quiet month is not a lost one. Rolled-over hours can be used only while the plan is active.

When a plan ends, at the end of the last period you paid for, the hours left from the plan end with it, and so do any free hours: trial hours, referral hours and hours we gave you. Only hours you bought outright stay (section 10).

A plan ends when you cancel it and the paid period runs out, when a payment fails and is not made good, or when the plan is refunded (section 11).

10. Hours you buy

  • You can buy hours outright, in packs, with or without a plan. A church on a monthly or yearly plan pays less per hour. A single event is the smallest pack, bought without a plan. Prices are on the pricing page and the events page.
  • Event Day and Conference are event packs: hours, plus the help their page describes, such as a rehearsal and someone to reach during the event.
  • Hours you buy are added straight away and never expire while your account exists. They stay when a plan ends.
  • If a payment for hours is refunded, or disputed with your bank and the dispute is lost, the hours it bought are taken back.

11. Refunds

  • You can ask for a refund within 30 days of a payment, by writing to hello@livefy.live.
  • We refund the hours of that payment you have not used, in proportion to the price you paid. Hours already used are not refunded.
  • Each church can have one refund. After a refund, no later payment can be refunded.
  • A refund of a plan payment ends the plan straight away, and the refunded hours are taken back. A refund of bought hours takes those hours back.
  • This applies to every purchase: monthly and yearly plans, hours, Event Day and Conference.

12. Referrals

  • A church can share its referral code. When a church that signed up with the code pays for its first plan, at half the plan’s price or more, it gets 10 hours. The church that referred it gets 10 hours when the new church pays for its next period after that (its renewal), or at once if that first payment was for a year, or when the new church moves to paying for a year.
  • The new church must really be a different church: a different card and different people. Two accounts for the same church do not earn referral hours.
  • Referral hours are free hours: they end when the plan ends (section 9).
  • If a payment that earned referral hours is refunded for half of it or more, or disputed and the dispute is lost, those hours are taken back: the first payment’s from both churches, the renewal’s from the church that referred.

13. Prices and taxes

Prices are in US dollars. Payments are made through our payment processor; we never see your full card number.

Checkout does not add sales tax. If a tax applies to your purchase where you are, you are responsible for it.

We may change prices. A new price for a plan applies from your first renewal at least 30 days after we email the account owner about it. Hours you already have do not change.

14. Accuracy

Livefy uses speech recognition and machine translation. It makes mistakes, most often with names, uncommon words and unclear sound. It is not a certified or professional interpreter.

Do not rely on Livefy where a mistake could cause harm, such as medical, legal or safety instructions, legal proceedings, or anything that needs a certified translation. Your church decides whether the captions are good enough to show, and is responsible for what it shows on its screens and in its stream.

15. Your services and your words

  • What is said at your services belongs to you, or to whoever said it. We claim no rights to it.
  • You give us permission to process the sound and the words of your services only to provide Livefy to you: to make captions and voice, deliver them to your screens and phones, and keep transcripts if you turn them on. The privacy policy names the companies that do part of this work for us.
  • You are responsible for having the right to use the sound you send us, for example a guest speaker’s agreement where your church asks for it, and the rights to anything you stream.

16. Fair use

Do not:

  • use Livefy for anything unlawful, or to spread hate, threats or harassment;
  • sell or share access to your account with another church or organisation, or open accounts to get more free hours;
  • try to get around the hours you have, the limits on free trials, or how we count hours;
  • copy, take apart or overload Livefy, or try to reach parts of it you were not given;
  • use Livefy through software you made or had made, rather than through Livefy's own pages, or run it automatically without a person running a service;
  • use Livefy, or what you learn from it, to build or improve a product that competes with it;
  • post your screen or phone links where people outside your audience can misuse them.

We may stop a service, suspend an account or close it if it is used in these ways.

17. When something goes wrong

We work to keep Livefy running every day, and especially on Sundays, but we cannot promise it will never fail. It depends on the internet, on your equipment and on the services of other companies. Test it before an important service or event.

If Livefy fails during a service because of a fault on our side, write to us and we will put back the hours that service used.

We improve Livefy all the time, so features can change. We will not take away a feature you rely on without telling the account owner first.

18. Closing an account

  • The owner can ask us to delete the account at any time by writing to hello@livefy.live. Deleting the account deletes its hours, including hours you bought. What we delete is set out in the privacy policy.
  • We may suspend or close an account that breaks these terms, or whose payments fail and are not made good. If we close an account for breaking these terms, its hours end and nothing is refunded.
  • If we stop offering Livefy, we will tell account owners at least 30 days before, and refund unused hours you bought and the unused share of your current plan period.

19. Limits of our responsibility

As far as the law allows:

  • Livefy is provided as it is, without promises beyond those in these terms.
  • We are not responsible for losses that come indirectly from using Livefy or from not being able to use it, such as lost donations, lost attendance or harm to reputation.
  • The most we can owe you for any claim is what your church paid us in the 12 months before the claim.

You agree to cover our costs if someone makes a claim against us because of what your church sent through Livefy or showed with it.

Some places do not allow some of these limits. Where they are not allowed, they do not apply to you.

20. Disagreements and the law

If something goes wrong between us, write to us first; we will try to put it right within 30 days. These terms are governed by the law of California. Any court case will be heard in the courts of Riverside County, California.

21. Changes to these terms

We may change these terms, and we post the new version here with its date. If a change takes away something you have, such as hours or a right to a refund, or costs you more, we email the account owner at least 30 days before it applies to you. Using Livefy after a change takes effect means you accept it.
